I. LUTUMURSI Store Privacy Policy

1. Who is the controller of your data?

The controller of your personal data is FUNDACJA ROZWOJU PRZEDSIĘBIORCZOŚCI “TWÓJ STARTUP” with its registered office in Warsaw (registered office address:
ul. Żurawia 6/12, lok. 766, 00-503 Warsaw).

This Privacy Policy applies to the Foundation’s services provided by the organised part of the enterprise LUTUMURSI Realizacje Firmowe, contact details: telephone number 698 921 132, e-mail address: lutumursi.design@gmail.com, carried out by Magdalena Stroszejn-Bronikowska.

2. Why do we process your data?

  1. In connection with services provided through LUTUMURSI involving the sale of handmade porcelain products, i.e. for the purpose of entering into or performing a contract (Article 6(1)(b) of the Regulation), your data will be stored until the contract has been performed.

  2. To comply with all legal obligations incumbent upon us in connection with our cooperation (Article 6(1)(c) of the Regulation). This purpose is related to statutory obligations to retain certain documents for the periods prescribed by law, for example under:

    • the Accounting Act of 29 September 1994 (Journal of Laws of 2017, item 1858);

    • the Tax Ordinance Act of 29 August 1997 (Journal of Laws 1997 No. 137, item 926);

    • the Act of 1 March 2018 on Counteracting Money Laundering and Terrorist Financing (Journal of Laws 2018, item 723).

  3. For the purpose of establishing, pursuing or defending against claims, where necessary, which constitutes our legitimate interest (Article 6(1)(f) of the Regulation). The data will be processed until the limitation period for claims expires.

  4. Where consent has been given, your data will be processed within the scope and for the purpose specified in that consent (Article 6(1)(a) of the Regulation). The data will be processed until consent is withdrawn.

3. What data do we process?

To enter into a contract, we require the data specified in the contract/order form (if you do not provide it, we will not be able to enter into the contract or fulfil the order). We may additionally request optional data that does not affect the conclusion of the contract (if we do not receive it, we may, for example, be unable to contact you by telephone).

During the term of the contract, in the course of providing services, we may obtain other data concerning you. The presence of your personal data in our systems is a consequence of the operation of the services that you use.

4. Who will the data be disclosed to?

  1. Public authorities, insofar as they do not receive the data in the course of a specific proceeding pursuant to law, for example in connection with anti-money laundering measures;

  2. Entities that process your personal data on behalf of the Foundation under a data processing agreement concluded with the Foundation (so-called processors). These may include, among others: beneficiaries of the Foundation, IT specialists, archiving companies and hosting companies;

  3. External data controllers (so-called independent/parallel controllers to whom data is disclosed), e.g. legal advisers and attorneys, courier or postal service providers, and entities acquiring receivables if our invoices are not paid on time;

  4. Entities located outside the EEA, but only where necessary and subject to ensuring an adequate level of protection, primarily through:

    1. cooperation with entities in countries for which an appropriate adequacy decision has been issued by the European Commission;

    2. the use of standard contractual clauses issued by the European Commission.

The Controller always informs data subjects, at the time the data is collected, of any intention to transfer personal data outside the EEA.

5. Is the data subject to profiling?

We inform you that your data will not be subject to profiling, i.e. automated analysis of your data and the preparation of predictions concerning your preferences or future behaviour (profiling means, for example, determining which offer you may be most interested in based on your previous choices in the context of marketing profiling).

6. What rights do you have?

  1. The right of access to the personal data processed by us (Article 15 of the Regulation);

  2. The right to rectification of the personal data provided to us, including correction thereof (Article 16 of the Regulation);

  3. The right to erasure of personal data from our systems, the so-called “right
    to be forgotten” – if you believe that there are no grounds for us to process your data, you may request that we erase it (Article 17 of the Regulation);

  4. The right to restriction of processing – you may request that we restrict the processing of your personal data solely to storing it or carrying out actions agreed with you if we hold inaccurate data about you or process it without sufficient grounds; if you do not want us to erase the data because you need it to establish, pursue or defend claims; or for the period during which an objection to processing is being considered (Article 18 of the Regulation);

  5. The right to data portability – you have the right to receive from us, in a structured, commonly used and machine-readable format (e.g. “.csv”), personal data concerning you that we hold on the basis of a contract or your consent. This right applies where we hold the data electronically; where the data is held only in paper form, this right cannot be exercised. You may instruct us to transmit this data directly to another entity (Article 20 of the Regulation);

  6. The right to withdraw consent to the processing of personal data – you may withdraw your consent to the processing of personal data that we process on the basis of consent at any time (Article 7(3) of the Regulation). Withdrawal of consent will not affect the lawfulness of processing carried out on the basis of consent before its withdrawal. Consent may be withdrawn by sending an e-mail to: lutumursi.design@gmail.com

  7. The right to object – you may object to the processing of your data where the basis for using the data is our legitimate interest (Article 21 of the Regulation). In such a case, after considering your request, we will no longer be able to process the personal data covered by the objection on that basis unless we demonstrate compelling legitimate grounds for the processing which override your interests, rights and freedoms.

  8. If, in your opinion, the processing of personal data infringes the provisions of the Regulation, you have the right to lodge a complaint with the supervisory authority, i.e. the President of the Personal Data Protection Office.

2. Types of Cookies

We use the following types of cookies on our websites:

Necessary/Technical: These cookies are necessary for the proper functioning of the website. In particular, they are installed to remember login sessions or form completion, as well as to remember whether you have been informed about the use of cookies.
